The Federal government sets the foundation for code, but each State can add to or delete from the Federal requirements as they see fit; this is why most do not meet the Federal Standard at all. FEDERAL ACCESSIBILITY GUIDELINES – these are a set of laws established by the Federal government to protect the civil rights of people with disabilities.

STATE TITLE 24 – Only three states have accessibility guidelines that match the Federal laws, which means that 47 states have local laws that conflict or ignore Federal mandates. Because Federal law supersedes local code, this discrepancy gives people a window of opportunity to sue your business.

As if that weren’t confusing enough, the codes change on a regular basis. Unfortunately there are people who make identifying (and suing) businesses out of compliance their life’s work.
